The terms and conditions governing your use of DriplyPay

Quick Summary

DriplyPay is a multi-surface creator operating system that connects cross-platform attention to monetization outcomes. We help creators see which social platforms actually drive revenue through profile surfaces, analytics, content monetization, and native payment processing via DriplyPay Wallet.

1. Acceptance of Terms

By accessing and using DriplyPay ("the Service"), you accept and agree to be bound by the terms and provision of this agreement.

Legal Entity: DRIPLYPAY (ABN 48 125 462 102), a registered Australian business based in Brisbane, Queensland. These terms are governed by Australian law.

If you do not agree to abide by the above, please do not use this service.

1.5. Age Requirements

You must be at least 18 years old to use DriplyPay. By using our service, you confirm that you meet this age requirement and have the legal capacity to enter into this agreement.

DriplyPay involves payment processing and financial services that require users to be of legal adult age. We do not knowingly provide services to anyone under 18 years of age.

2. Service Description

DriplyPay provides a complete creator monetization platform that allows creators to:

  • Create customizable profile pages with analytics
  • Display links to external payment platforms (PayPal, CashApp, etc.)
  • Accept tips and payments via DriplyPay Wallet
  • Sell content (photos, videos, PDFs, audio, courses) with pay-per-view or subscriptions
  • Share social media links with performance tracking
  • Generate QR codes for easy profile sharing
  • Access revolutionary platform-to-payment correlation analytics

Payment Processing: DriplyPay operates as a hybrid platform. External payment links (PayPal, CashApp, etc.) route users to those services—we don't process those transactions. For DriplyPay Wallet (tips, pay-per-view, creator subscriptions), DRIPLYPAY (ABN 48 125 462 102) is the merchant of record. Fan card payments are processed through authorised third-party payment service providers. DriplyPay Pro and Agency platform plans are billed separately via Stripe.

2.5. Payment Processing & Billing

Merchant of record

When you purchase creator content, send a tip, or subscribe to a creator on DriplyPay, you are transacting with DRIPLYPAY (ABN 48 125 462 102), operated by Darrion Daniel Gosley trading as DRIPLYPAY, Queensland, Australia. Creators are paid by DriplyPay from platform earnings — fans do not pay creators' personal bank accounts directly.

Bank statement descriptor

Charges for creator tips, pay-per-view purchases, and fan subscriptions may appear on your statement as DRIPLYPAY or DRIPLYPAY.COM, or a neutral descriptor used by our payment processor. If you do not recognise a charge, contact support@driplypay.com before initiating a chargeback.

Cancelling creator subscriptions

Creator subscriptions renew automatically until cancelled. Cancel via your DriplyPay account settings or email support@driplypay.com with the subject "Cancel Subscription". Cancellation stops future renewals; access continues until the end of the current paid period.

Fees

A 12.5% platform fee applies to DriplyPay Wallet transactions. Minimum purchase price where applicable is $8.00 AUD. Prices are displayed in AUD unless stated otherwise.

3. User Accounts

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring your profile information is accurate and up-to-date
  • Immediately notifying us of any unauthorized use of your account

4. Acceptable Use

You agree not to use DriplyPay to:

  • Upload, post, or transmit any content that is illegal, harmful, or violates any laws
  • Impersonate any person or entity
  • Collect or store personal data about other users
  • Interfere with or disrupt the service or servers
  • Use the service for any fraudulent or inappropriate purpose

4.5. Explicit Content & Age Verification

Explicit Content (18+)

Creators may publish and monetise age-restricted (explicit) content on DriplyPay subject to the following conditions:

  • The creator must complete government ID age verification via our approved identity verification provider
  • The creator must be at least 18 years of age
  • Subscribers and buyers of explicit content must also complete age verification
  • All individuals depicted in explicit content must be at least 18 years of age
  • Content must comply with all applicable laws in Australia and the jurisdiction of the creator

Absolutely Prohibited (Zero Tolerance)

  • Any sexual content depicting or implying a minor (CSAM) — reported to NCMEC and law enforcement immediately
  • Non-consensual intimate imagery (revenge porn)
  • Content involving trafficking, coercion, or exploitation
  • Content that violates our payment processor or card network acceptable use policies

Violations result in immediate account termination and referral to law enforcement. No appeal is available for CSAM-related terminations.

Platform Fee: A 12.5% platform fee applies to all transactions including explicit content. The minimum price for any paid content or subscription is $8.00 AUD.

5. Content and Intellectual Property

You retain ownership of all content you upload to your DriplyPay profile. By using our service, you grant us a limited license to display your content as part of the service.

DriplyPay respects intellectual property rights and expects users to do the same.

5.5. Copyright & DMCA Takedown Policy

DriplyPay respects the intellectual property rights of others and expects users to do the same. We respond to notices of alleged copyright infringement in accordance with the U.S. Digital Millennium Copyright Act (DMCA), Australian Copyright Act 1968, and equivalent international copyright laws.

Filing a Copyright Complaint (Takedown Notice)

If you believe content on DriplyPay infringes your copyright, send a written notice to our designated agent containing:

  • Your physical or electronic signature (as copyright owner or authorized agent)
  • Identification of the copyrighted work(s) you claim have been infringed
  • Identification of the infringing material and its location on DriplyPay (URL)
  • Your contact information (address, phone number, email)
  • A statement that you have a good faith belief the use is not authorized
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

Counter-Notification (If Your Content Was Removed)

If you believe your content was removed in error, you may submit a counter-notification containing:

  • Your physical or electronic signature
  • Identification of the removed material and its former location
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  • Your name, address, phone number, and consent to jurisdiction

Response Time: Valid takedown notices are processed within 48-72 hours

Repeat Infringer Policy

DriplyPay maintains a policy of terminating accounts of users who are repeat copyright infringers. Users who receive multiple valid takedown notices may have their accounts suspended or permanently terminated at our discretion.

5.6. Content Reporting & Abuse

DriplyPay is committed to maintaining a safe platform. We take reports of illegal content, fraud, and abuse seriously.

Automated Child Safety Screening

DriplyPay uses PhotoDNA technology licensed by Microsoft at no cost to scan uploaded images and videos for known child sexual abuse material (CSAM) before publication.

If media is flagged, publication is blocked, the upload is removed from user-accessible storage, the associated account may be suspended pending review, and confirmed matches are reported to appropriate authorities including NCMEC where applicable.

Match details are not disclosed to uploaders or other users. PhotoDNA is used solely for child safety — it does not scan for general adult content or copyright infringement.

Zero Tolerance Content (Immediate Removal & Report to Authorities)

  • Child sexual abuse material (CSAM) - Reported to NCMEC and law enforcement
  • Terrorism or violent extremism content
  • Content depicting or promoting violence against individuals
  • Human trafficking or exploitation
  • Non-consensual intimate imagery

Prohibited Content (Removal & Account Action)

  • Fraudulent schemes or scam operations
  • Impersonation of other individuals or brands
  • Harassment, hate speech, or discriminatory content
  • Malware, phishing, or deceptive links
  • Content that violates applicable laws in your jurisdiction

How to Report Content

Include:

  • URL of the content
  • Description of the issue
  • Any evidence supporting your report (screenshots, etc.)

Response: Reports are reviewed within 24-48 hours. Urgent safety concerns (CSAM, immediate threats) are prioritized and may be escalated to law enforcement.

Law Enforcement Cooperation

DriplyPay cooperates with law enforcement agencies investigating illegal activity. We may disclose user information in response to valid legal process (subpoenas, court orders, search warrants) or when we believe in good faith that disclosure is necessary to prevent imminent harm, protect rights, or comply with legal obligations.

7. Disclaimers

DriplyPay is provided "as is" without any warranties, expressed or implied. We do not guarantee that the service will be uninterrupted or error-free.

We are not responsible for any transactions that occur through external payment platforms linked from your profile.

8. Limitation of Liability

In no event shall DriplyPay be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

9. Termination

We may terminate or suspend your account if you materially breach these Terms, engage in fraudulent activity, violate applicable laws, or misuse the platform in ways that harm other users or the service.

Where possible, we will provide reasonable notice before termination unless immediate action is required for security or legal reasons. You may appeal any termination decision by contacting support.

You may terminate your account at any time by contacting us or deleting your account through the platform.

9.5. Consumer Rights & Refunds

Creator fan purchases (tips, PPV, creator subs): Digital content purchases and tips are generally final once delivered. Refunds are not guaranteed except where required by applicable consumer law.

Creator subscriptions: Can be cancelled at any time and will not renew at the next billing cycle. No partial refund is provided for the remaining period unless required by law. Cancel via your account or email support@driplypay.com.

Pro/Agency platform plans: Billed via Stripe. Refund policy for platform subscriptions is described in our Help Center.

Statutory Rights: Nothing in these Terms excludes or limits your statutory consumer rights under applicable law, including the Australian Consumer Law, UK Consumer Rights Act 2015, EU Consumer Rights Directive, or similar protections in your jurisdiction. Where a statutory right applies that cannot be excluded, we will honour it.

Chargebacks: Initiating a fraudulent chargeback may result in immediate account suspension and recovery of the disputed amount plus any fees incurred.

Taxes: Creators are solely responsible for reporting and paying any applicable taxes on income earned through the platform, including income tax, GST/VAT, and any other applicable taxes in your jurisdiction. DriplyPay does not provide tax advice and recommends consulting a qualified tax professional.

10. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Queensland, Australia.

Any disputes arising from these terms or your use of DriplyPay will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

For international users: By using DriplyPay, you agree to Queensland law and jurisdiction for any legal matters.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
